Reseller Policy

POLICY CONCERNING THE ELIGIBILITY AND COMPLIANCE OF THIRD-PARTY MERCHANTS TO SELL BAR B QUE SPECIALTIES, INC. PRODUCTS AND REPRESENT ITS BRANDS

It is in the express interest of Bar B Que Specialties, Inc. and its associated authorized distributors and resellers to preserve the goodwill acquired through the design, development, manufacture, marketing, and distribution of its products and brands, including but not limited to Fat Boy Hickman’s BBQ®, Hickman’s BBQ®, and associated product lines.

Bar B Que Specialties, Inc. has invested substantial resources in the development, marketing, and protection of its products and brands and does not authorize the sale of its products on third-party online marketplaces or platforms by distributors, wholesalers, or resellers.

1. Products and Brands

Images and Marketing Materials

  • Bar B Que Specialties, Inc. may provide approved product images, logos, descriptions, and marketing materials for use by authorized resellers.
  • Only approved images and branding materials provided or authorized by Bar B Que Specialties, Inc. may be used in connection with the sale or promotion of its products.
  • Resellers may not alter product labels, logos, trademarks, packaging, product descriptions, or marketing materials without prior written approval from Bar B Que Specialties, Inc.
  • In the event branding, packaging, or imagery is updated, authorized resellers will be notified and expected to update their materials and listings within 30 days.

2. Distribution

  • Authorized resellers may sell Bar B Que Specialties, Inc. products only through physical retail locations or websites that are owned and operated by the reseller.
  • No distributor, wholesaler, broker, reseller, or retailer is authorized to sell Bar B Que Specialties, Inc. products on any third-party online marketplace or platform.
  • Prohibited marketplaces include, but are not limited to, Amazon, Walmart Marketplace, eBay, Etsy, TikTok Shop, Temu, Target, Pinterest, Home Depot, Lowes, Facebook Marketplace, Faire, and similar third-party selling platforms.
  • Authorized resellers may not supply products to any third party for resale on online marketplaces or unauthorized ecommerce channels. 
  • Drop shipping through third-party marketplaces, fulfillment partners, or unauthorized ecommerce accounts is strictly prohibited.
  • Bar B Que Specialties, Inc. does not authorize the creation of marketplace listings using its trademarks, product names, images, or intellectual property without prior written consent.
  • Failure to comply with any distribution requirements contained in this policy may result in the immediate termination of the reseller’s, distributor’s, or wholesaler’s account and eligibility to purchase products from Bar B Que Specialties, Inc.

3. Product Integrity

  • Resellers must store, handle, and market products in a manner consistent with maintaining product quality, freshness, and brand reputation.
  • Products may not be relabeled, repackaged, bundled, modified, or otherwise altered without prior written approval from Bar B Que Specialties, Inc.

4. Compliance and Enforcement

  • Failure to comply with this policy may result in immediate suspension or termination of reseller status, cancellation of pending orders, refusal of future sales, and additional enforcement actions as deemed appropriate by Bar B Que Specialties, Inc.
  • Bar B Que Specialties, Inc. reserves the right to monitor reseller activities, websites, and online marketplaces to ensure compliance with this policy.
  • Any unauthorized online marketplace listings may be subject to takedown requests, trademark enforcement actions, or other corrective measures.

Bar B Que Specialties, Inc. reserves the right to amend, modify, interpret, or terminate this policy at any time without prior notice.
